NAFTA Tribunal Upholds 'Promise Utility Doctrine' Under Canadian Law

Abstract
A three (3) member arbitral Tribunal constituted under Chapter Eleven of the North American Free Trade Agreement, unanimously held that the changes to the “promise utility doctrine” under Canadian patent law were “incremental” and “evolutionary” and had not been fundamentally or dramatically altered by the Canadian Courts.
