Abstract
This short essay responds to Gillian E. Metzger, The Supreme Court, 2016 Term — Foreword: 1930s Redux: The Administrative State Under Siege, 131 Harv. L. Rev. 1 (2017). There are good reasons to express skepticism about certain aspects of today's administrative state. The truth is that the administrative state is a work in progress and sometimes loses its way. We should not be reluctant to say so.
