Abstract

Dutch Abstract: De heer P.N., Duits staatsburger, kocht medio 2011 een fiets op de vlooienmarkt voor 29 euro. Die fiets was gestolen en daardoor kwam P.N. in beeld van de politie van Dresden op verdenking van heling. Bij de opsporing en vervolging werden identificerende gegevens van de verdachte verzameld, waaronder foto’s van gezicht en lichaam van de verdachte, en vinger- en handpalmafdrukken. In deze zaak staat centraal of de identificerende gegevens mochten worden afgenomen bij verdachte. In deze annotatie wordt onderzocht in hoeverre privacyinbreuken gerechtvaardigd zijn tijdens de opsporing.

English Abstract: Mr. P.N, a German citizen, purchased a bicycle on the flea market for 20 Euro mid 2011. Since the bicycle was stolen, P.N. attracted the attention of law enforcement in Dresden on the suspicion of fencing. During the criminal investigation and prosecution, identifying data of the suspect were collected, including images of the face and body of the suspect, fingerprints and palmprints. In this case, the central legal question is whether these identifying data were legally taken from the suspect. In this annotation it is investigated to what extent privacy violations are allowed during criminal investigations.
