Abstract

The American Law Institute recently embarked on the Restatement Third of Economic Torts. The project raises a host of important issues. When should actors be liable for conduct that causes purely economic loss? To what extent do basic elements of negligence law play a role defining economic torts claims? How do conceptual changes in other areas of law, such as apportionment of liability, impact the economic torts? In this article, which introduces the Dan B. Dobbs Conference on Economic Torts, Professor Bublick outlines important themes that cut across the economic torts. Within that framework she reveals the sharp controversies and general agreements among the authors who participated in the Economic Torts conference.
