Abstract

The decision of the Court of Criminal Appeal in Sim Ah Cheoh v. P.P. is one of the latest in a spate of recent cases dealing with the taking of statements under section 122(6) of the Criminal Procedure Code (CPC). The cases, including this one, point to a deep disquiet about the operation of the section. This note analyses the decision particularly with respect to the role of the officers recording such statements and the admissibility of such statements.
