Beyond the Law? Interrogating the Scope of Common Farming Exemptions: Many animal protection laws exempt “accepted,” “common,” “customary,” or “normal” farming practices. The conventional wisdom—which animal law scholars and advocates have almost universally accepted—is that exempted farming practices are whatever industry proclaims them to be, and that the exemptions thus effectively put farmed animals beyond the reach of the law. This paper will challenge that conventional wisdom and argue that despite these exemptions, numerous farming practices—including standard industrial practices—can be legally challenged.
