The Parameters of Individual Privacy Narrowly Strengthened in Carpenter v. United States, The U.S. Supreme Court’s Most Recent Privacy Ruling
The United States Supreme Court again analyzed the profoundly complex and bedeviling issue of individual privacy in the landmark case of Carpenter v. United States, 585 U.S. ____ (2018), the most recent of a long line of Fourth Amendment cases. The question of exactly where to delineate the parameters of privacy is one that is far from over, however. The Supreme Court revisited and expanded upon this query from its most recent privacy-related decisions in Riley v. California, 573 U.S. __ (2014), and United States v. Jones, 132 S.Ct. 945 (2012), all part of the Katz v. United States, 389 U.S. 347 (1967), progeny. Notably, this case also overturned the third party doctrine of United States v. Miller, 425 U.S. 435 (1976), and Smith v. Maryland, 442 U.S. 735 (1979). In the 5-4 decision, Chief Justice John Roberts delivered the majority opinion.
