I just completed another article on Section 230 of the Communications Decency Act. This piece addresses the way Section 230 enables the proliferation of child sexual abuse material (CSAM), also known as child pornography, on the Internet. It digs deeply into the legislative history to argue that Section 230 and the CDA actually should be viewed as laws not agnostic to child protection, but seeking child protection. Through this lens, the current broad immunity Big Tech claims the law provides is a false narrative that must be corrected, as it is directly opposed to the original intent of Section 230 and has led to a reality many in Congress sought to prevent.
