Abstract

In this article I discuss the possibility that the uncritical use of modern constitutionalism in legal cultures that are not accommodating to the underlying philosophical foundations of that concept could lead to situations of intra and international violence. In this view, modern constitutionalism is not a universal good that can be transported to any cultural situation.
