This Research Paper analyses the Draft Revised Basic Proposal for a WIPO Treaty on the Protection of Broadcasting and Cablecasting Organizations in light of global trends towards media convergence and concentration in the digital environment.
Among others, the Paper considers: The extent to which the proposed protection is necessary and would address the problems faced by broadcasting and cablecasting organizations; The impact of the proposed approach on other stakeholders and access to knowledge in developing countries.
Overall the Paper concludes that there is a lack of evidence to support the granting of the array of rights proposed to broadcasting and cablecasting organizations and that in the short and long-term the Treaty would likely bring more economic and social costs than benefits for developing countries.
