تحاول هذه الدراسة معايرة الماضي الدستوري العراقي من وجهة نظر أوربية، سعياً لإستقبال المفهوم الأوربي لدولة القانون الى الفكر الدستوري العراقي والعربي عامة، عن طريق غرس مفهوم التغاير السياسي كمحرك فكري واسع المفهوم للديمقراطية الدستورية المزمع غرسها في العراق. المحاولة تتطرق الى الزعم بزرع مفهوم توازن السلطات الدستورية عن طريق معايرة القوى السياسية، وإيجاد منظومة ديمقراطية متعددة المعايير تتماشى وخصوصيات المجتمع العربي. الورقة تراعي مفارقات الوضع السياسي العراقي الرامي لبناء دولة دستورية والإنتقال التدريجي تماشياً مع أزمة إنعدام المهوم المؤسساتي للدولة الراهنة. من جان آخر، الورقة تحاول طرح مصالحة الأقطاب الإجتماعية في المجتمعات متعددة الإنتماءات، كحل مستقبلي لبناء الدستور العراقي، عن طريق نقل التجربة الإسبانية والفرنسية الحديثة.
نُشِرَت هذه الورقة باللغة العربية في كتاب جماعي بتنسيق البروفيسور الراحل محمد شريف بسيوني، تحت عنوان "دراسات دستورية عراقية"، المركز الدُولي للقانون الإنساني، جامعة شيكاغو في كانون الثاني، يناير 2005، ما بين صفحة 469 إلى 518.
English Abstract: This paper trait to report Iraqi constitutional past -experience, analysing it through an occidental point of view and experience to compare between its own characteristics and the Rule of Law institutions and the manner to be transmitted to Iraqi scholars. Promoting a new dimension of political pluralism as a motor of political ideology toward a lato democratic constitutionalism. Trying to contribute to alternative political disputes solutions through constitutional review, and the creation of democratic control institution in the oriental societies. Treating the formation of a modern state in Iraq difficulties, and the administration of the transactional process.
The contribution tray to find social and demographic solutions for the future constitutional equivalence of Iraq, in demonstration of other occidental models such as the Spanish and the French constitutional life.
