في سبيل المستقبل الدستوري (Toward the Constitutional Future)

تقدم هذه الورقة أفكاراً ومقترحات نظرية وعملية للمشرع الدستوري نابعة من التجربة الدستورية الإسبانية لسنة 1978 والفرنسية لسنة 1958. عن طريق طرح أفكار ومفاهيم للحقوق والحريات الفردية وكيفية غرسها في المحور الدستوري العربي بما يتلائم مع حاجات الفكر والمجتمع العربي. أي إنها مغايرة لمعايرة المفهوم الأوربي لمحاورة بلورته عربياً. من جانب آخر، تحاول الورقة طرح مفهوم التوازن المؤسساتي في الدولة المسلمة لدرء مأزق نبذ الإنتماء الروحي، وإيجاد سلطة توازن ديني ذات بعد مؤسساتي للدولة، بدون مقامرة سياسية. أي عن طريق إقتراح إيجاد سلطة مشاركة عقائدية منفصلة عن سلطات الدولة، لكن تحت رعايتها بتأثير أحادي الإتجاه كمفهوم يتماشى مع حاجات المجتمع العربي والدولة العقائدية. من جانب آخر، تنتقل الورقة لتناول مشكلة أخرى تاه فيها الفكر الأوربي المعاصر نابعة من معظلة التفسير القضائي للنصوص الدستورية والذي قاد التجربة الدستورية الأوربية الى مفاهيم الأمركة القانونية وضياع الإعتبار الوضعي للقانون، لتحل السوابق الدستورية محل الدستوري، وتنصيب القضاء الدستوري محل مؤسس الدولة، عن طريق عرض التجربة الإسبانية 1981 الى 2001. وأخيراً تطرح الورقة محاولة لتطوير القضاء الإداري العربي، عن طريق إدخال مفهوم القضاء الإداري وتفعيله في الدساتير العربية.

نُشِرَت هذه الورقة باللغة العربية في كتاب جماعي بتنسيق البروفيسور الراحل محمد شريف بسيوني، تحت عنوان "دراسات دستورية عراقية"، المركز الدُولي للقانون الإنساني، جامعة شيكاغو في كانون الثاني، يناير 2005، ما بين صفحة 113 إلى 170.

English Abstract: The contribution turns around the constitutional text -making and its methodology, departing from occidental constitutional values, principally the Spanish 1978, and the French 1958. Through several constitutional institutes references from Individual Rights, objective and subjective rights, and the structure of constitutional chart regarding the national institutions, and the constitutional review. Trying to contribute to a theory of asymmetric federalism into different communities, ethnicities religious belongings in the Iraqi societies distinguishing between communities, spiritual authorities, and political collectivities, where is deeply mixed in political conception in the Middle East.

Moreover, the paper tray to contribute to another theory of constitutional interpretation through the actual experience of the Spanish legal system, which had been conducted toward the Americanization of the Spanish constitutional practice. Through a case -law study in the Spanish constitutional court decisions 1981-2001, the analysis demonstrates pragmatic constitutional activism and deficit in legal reasoning.

Finlay, the paper tray to contribute to the theory of judicial administrative review in the Middle East, from abstract judicial activism upon the political power, constituting new democratic dogma from occidental rule of law theory.
