ICSID Jurisdictional Issues: Problems, Solutions and Recommendations for a Better Understanding in International Commercial Relations (International Investment Arbitration, Economic Development)
Faculty of Law, University of Buenos Aires
July 1, 2008
This paper goes through the existing relationship between the concept of economic development and the jurisdiction of the International Centre for the Settlement of Investment Disputes. It demonstrates how the absence of a contribution by the so called "investment" to the development of the Host Country may result in a valid ground for a "lack of jurisdiction" objection before the Centre.
