Creative Commons Licenses: The Brazilian Experience

The paper analyses the implementation of Creative Commons licenses in Brazil provided that the role of public institutions and academia has been remarkable and that such licenses are perceived as a pivotal element in the modernisation of the national legal framework concerning intellectual property rights and, in particular, copyright. Apart from the strictly contractual and legal point of view, the paper will address some economic and social aspects and in particular it will assess whether and to what extent Creative Commons licenses (and intellectual property rights) can enhance economic and social growth through the creation of SMEs and SME clusters, with a special focus on the role played by the Pontos de Cultura in the Brazilian society.
