Abstract
English criminal law maintains an exculpatory doctrine for defendants who kill upon provocation. The article examines the normative test in provocation following the House of Lords' recent decisions in R v. Morgan Smith and Attorney-General for Jersey v. Holley, in light of the Law Commission's recent proposals to reform the law of fatal offences against the person.
