Abstract

This paper which is both a doctrinal and legal comparative piece, reviews and analyses issues related to expropriation and takings in Nigeria with particular reference to expropriation of mineral rights and to this extent the paper is doctrinal. It is also a comparative in the sense that it seeks to carry out a legal comparative with the takings regime in the United States and Canada.

Very importantly, the paper takes a look at expropriation in Nigeria from an international law perspective; reviewing the principal investment and anti- expropriation law with consideration given to international arbitration and resolution of investment disputes.
