Abstract

This comment argues that the Supreme Court's decision in Simmons v. South Carolina, 512 U.S. 154 (1994) should be applied retroactively. The comment was cited by Justice Stevens in his dissent in O’Dell v. Netherland, 521 U.S. 151 (1997).
