Abstract

This article provides a systematic analysis of three related concepts: waiver, acquiescence and prescription. It assess their treatment, by the UN International Law Commission, in its work on State responsibility. It identifies common features of all three notions, which much of the literature, focusing on waiver, acquiescence or prescription separately, has tended to overlook.
