Abstract

The Review of the Competition Law Provisions of the Trade Practices Act (The Dawson Report) was released by the Australian Government in April 2003. The first substantial chapter in the report relates to mergers. While recommending the existing substantial lessening of competition test be retained, the Committee made a number of significant recommendations for procedural change in the assessment of proposed mergers. This paper examines those recommendations.
