The rule in Cherry v. Boultbee is susceptible to contractual exclusio. The Court of Appeal’s explanation in Re SSSL Realisations (2002)  EWCA Civ 7 of the calculation methodology is challengeable on grounds of mathematics, principles and authorities. The English court should consider adopting the Australian interpretation of the rule in Cherry v. Boultbee.
