Abstract

The purpose of this reflection piece is to provide a critical comment on the Swedish Supreme Court's decision in the European arrest warrant case of Ö-430-07, Biszak v. State Prosecutor and to assess it in the light of not only the notion of mutual trust as such but also the EU principle of non-discrimination.
