Abstract

In this case comment, the author reports on a state court case considering whether a putative father has a constitutional right to request a paternity test for a child born to a woman married to another man at that time. In rejecting the man's contention, the Supreme Judicial Court of Massachusetts ruled that society's interest in maintaining family structures outweighed the putative father's rights to be recognized.
