Abstract

Deterrence plays a vital role in acheiving the end of punishment. The concept of deterrence effect in capital punishment has accelerated the debatesabout its abolition or retention. As per few jurists capital punishment does deter and for others it does not . Paper gives a conceptual overview of the deterrence theory which becomes the focal point and basis of the existence of death sentence in various statutory books. Retention of Deah Sentence in the statutory book causes no harm till used judiciously and excuted timely expelling all the arbitrariness.
