Abstract

This is a short paper developed out of a 2006 speech comparing Kelsen's Pure Theory of Law to other early 20th century modernist movements, in particular with the Logical Positivism of the Vienna Circle. It focuses on the question of whether, in what sense and how Hans Kelsen can be described as legal modernist. It will discuss whether Kelsen was a modernist by the standards legal science has informally and subconsciously developed for modernism.
