Abstract

Rape within marriage is rarely reported or tried. Easteal examines some of the reasons why, surveying the aetiology of the alleged exemption, the reforms, and their problems and pitfalls in implementation. These include low prosecution, the issue of how consent is constructed in this context, and sentencing.
