Abstract

This research concern the legality of set-asides for local residents in municipal building contracts. The United States Supreme Court considered whether the Mayor of Boston’s Executive Order instituting this policy violated the commerce clause of the United States Constitution. The author analyzes the Court’s decision in which it rejected this challenge and details recommendations for contractors and city solicitors with respect to future work in this area.
