Regarding the penal type of undue use of falsified or stolen credit or debit cards, introduced to Chilean penal law through Law N° 20.000 of 2005, the author analyzes the current legal status quo regarding these behaviors, in the context of a general discussion regarding crimes against property and patrimony. After confirming the existence of an important legal loophole and presenting available comparative applicable models of regulation, the author carries out a critical assessment and a dogmatic analysis of the new norms
