Abstract
The paper assesses the impact on the EU treaty revision process from 2000 to 2009 of constitutionalism as a tool for analysis of the European Union. The European Constitution has been a political concept and a legal concept. Concentrating the debates on Constitutionalism has however led to forget the consequences of the fact that the EU constitution was and remains founded on international treaties, i.e. an agreement between states.
