Abstract

The American system of food safety regulation is inherently flawed. Genetic modification is the new frontier of food regulation and is destined to follow the same flawed path. Absent a complete overhaul of the current regulatory scheme, tort litigation is the only way to punish producers who provide flawed products and demand better quality in the market. Traditional products liability litigation provides a usable framework in this context.
