Property rights are fundamental prerequisites for the smooth societal organization. It is also the basic necessity for a smooth functioning of the market economy. Market process helps societies to solve its myriad problems, including providing justice to the victims in the judiciary market. Property rights violations are serious crimes and the wrong doers must be punished to give justice to the victims. Rape is a serious violation of individual’s fundamental property right in his/her body. This paper focuses on how judiciary market can provide justice to the rape victims by punishing them according to their property rights violation crime. The basis for the provision of justice is the libertarian punishment theory.
