Abstract

Plaintiff successfully sued defendant, who shooed her away from his jewelry store. In a lengthy opinion, the judge cited the Racial Discrimination Convention to hold the defendant liable for emotional distress damages, and gave a long historical account of the rise of human rights and racial discrimination. This is the first in a long line of racial discrimination cases in the private sphere.

Keywords: racial discrimination, private sphere, domestic application of international law, shooing away
