Abstract

This article discusses the civil penalty remedy in the citizen suit provision of the Clean Water Act (CWA); describes the holding in Pennsylvania Environmental Defense Foundation v. Bellefonte, which limits the civil penalty remedy; and analyzes the implications of that holding for citizen suit enforcement of the CWA.
