About Droit De Suite: Critical Analisys of the Right of Artists to Obtain a Participation in the Resale Price of Their Works (Consideraciones Sobre El Droit De Suite: Análisis Crítico Del Derecho De Los Artistas a Obtener Una Participación En El Precio De Reventa De Sus Obras)

Abstract

The institution of Droit de Suite allows artists to be financially linked to the value of their works since they receive a participation of the resale value of their works under certain circumstances. In this work I focus on many arguments against the current method of establishing droit de suite. Among others, I question whether it would be better to fix a percentage on the value of the profit made by the reseller and not the value of the sale; I also examine the diference between authors (writers and sculptors) and artists. I also focus on the effect that this right has on the market and investors.

La institución del Droit de Suite permite a los artistas estar financieramente vinculados al valor de sus obras ya que reciben una participación en el precio de reventa de sus obras bajo ciertas condiciones. En este trabajo me enfoco en los argumentos en contra del método actual para establecer el droit de suite. Entre otros, cuestiono que podría ser mejor fijar el valor según la ganancia del revendedor y no el valor de la venta, también examino la diferencia entre autores (escritores y escultores). También me enfoco en los efectos que este derecho tiene en el mercado y los inversionistas.
