Abstract

This review article focuses on the value of republicanism for contemporary legal theory. In particular, the review emphasizes the link between normative positivism and a republican approach to the concept of law. In this sense, legal republicanism brings with it certain necessary features of the law: its public character and its democratic origin. The review also questions which version of deliberative democracy is the most appropriate for republican law.

Keywords: Legal Republicanism, Normative Positivism, Non-Domination, Deliberative Democracy
