Abstract

In this article the Author analyses the most relevant doctrines on transnational public policy. Starting from a case decided by an ICSID Tribunal, the WDF v. Kenya case, this article concludes that under the ICSID system it is possible to speak about public policy on a juridical, and not on a simple moral, basis.
