Judicial Exchange between Australia and Japan

Abstract
Over the last few decades, a sense of collegiality has emerged amongst judges from different international jurisdictions. The frequency and intensity of communications between judges from different systems has developed to a very considerable extent. This paper discusses the bilateral relationship between Australia and Japan, and an exchange program for Japanese and Australian judges to visit each other’s jurisdictions. It surveys the means by which judges are prepared to assist those from other jurisdictions in cross-border disputes, and includes a discussion on the enforcement of foreign judgments and orders, the increased convergence between common law and civil law jurisdictions, and the development of multilateral frameworks for cooperation through UNCITRAL, The Hague Conference on Private International Law and UNIDROIT.
