Abstract

This essay examines the influence of Hans Kelsen’s theory of the Grundnorm among New Zealand’s legal academics. It focuses on the work of F.M. Brookfield, David Williams, and Philip Joseph, and explores the ways in which these authors have used (and departed from) Kelsen’s work in order to explain the ultimate origins of New Zealand’s constitutional system.
