Abstract

Este trabalho analisa o projeto de novo Código de Processo Civil Brasileiro. Com base na experiência norte-americana, os autores concluem que a coisa julgada sobre questões não deve ser adotada no Brasil porque não será capaz de promover economia ou efetividade processual e, pelo contrário, tornará os processos judiciais mais demorados e complexos.

This paper analyses the new proposed Brazilian Code of Civil Procedure. Based on the US experience, the authors conclude that issue preclusion should not be adopted in Brazil because it does not promote procedural economy or effectiveness but, on the contrary, make actions longer and more complex.
