Abstract

The Consultation Docement provides a useful start to the debate on legislation but is quite vague in places and does not provide the actual statutory language that would be used for certain new offences. It is essential that the government release a White Paper after it considers the comments arising from this consultation exercise. Lawyers and experts in the relevant fields may be able to identify problems in the statutory language which the government would not necessarily have noticed. However, this process will be inadequate if the government does not allow an additional period of consultation on a White Paper.
