Abstract

November 2010. Two years later. Exactly two years from the four decisions of the United Sections of the Supreme Court of Cassazione (numbers 26972/3/4/5. 11.11.2008) that have changed the whole architecture of the non-pecuniary damage in Italy, causing in the academia and among legal practitioners effects not so dissimilar from the opening of Pandora's box. In this paper I will describe the emerging new structure and so analyze the initial results with particular attention to the new scenarios on the so called “danno esistenziale.”
