Abstract

Romanian justice has a long meandering development after the fall of the communist regime of December 22, 1989. She suffered multiple violations of independence. There remains, of course, discuss the functional independence of prosecutors, but the Romanian society should accept it and press the politicians into accepting the independence of prosecutors. It is also necessary to strengthen the independence of justice and the confidence of Romanian society in an independent judiciary, to create conditions to prevent the incompetence of certain magistrates, and to organize an objective assessment of courts and judges.

In any case, we can now reasonably expect to turn around, that would make justice the instrument of a new totalitarianism is impossible.
