Abstract

Judge Jack Weinstein's sentencing jurisprudence is like the rest of his jurisprudence: powerful, creative, academically thorough, and often subject to reversal! His persistence is partially responsible for today's advisory sentencing guidelines. We can say of Judge Weinstein what he said of Learned Hand's description of Judge Cardozo: [He] never disguised the difficulties, as lazy judges do, who win the game by sweeping all the chessmen off the table."
