In this article I discuss article 1524 of the Belgian Judicial Code, which was introduced by the Act of 29 May 2000 and which changed the seizure law on movables. The new regulation leaves several questions unanswered.
In this article I firstly describe the theoretical framework. I elaborate on the new position of the opposing creditor as well as the concept of seizure.
Given the above and the purposes of the legislator, I formulate in conclusion some propositions with a view of a realistic execution of the rules in practice.
