Abstract

French Abstract: Des quatre classes d’obligations de la classification justinienne – ex contractu, quasi ex contractu, ex delicto et quasi ex delicto – la catégorie quasi contractuelle est celle qui a résisté le plus longtemps aux efforts de rationalisation. Cet article se propose de justifier son remplacement par la catégorie d’enrichissement injustifié, qui en constitue le seul fondement possible. La reconnaissance de cette réalité oblige toutefois à un certain nombre d’ajustements.

English Abstract: Of Justinian’s four classes of obligations (ex contractu, quasi ex contractu, ex delicto, quasi ex delicto), the quasi-contractual one has resisted rationalization the longest. This article (in French) makes the claim that quasi-contracts should disappear, as a category, from French law and be replaced with a general action in unjustified enrichment. It also explores the difficulties that such a switch would entail.
