Abstract
Case-comment in leading (peer-reviewed) IP law review in the Netherlands on first ruling of the European Court of Justice on 'bad faith'. The ECJ ruling was rendered on 11 June 2009 (Lindt v Hauswirth). The article explores how under European trademark law trademarks can be invalidated on the grounds of bad faith. The article also discusses the impact on Benelux trademark law and the inadmissibility of shape marks.
