An update on where matters stand with respect to all aspects of the litigation and arbitration proceedings between Texaco/Chevron and Ecuador, including U.S. proceedings (RICO action, Section 1782 applications for discovery in aid of foreign proceedings), the Bilateral Investment Treaty arbitration and the Inter-American Commission on Human Rights. The article also discusses the interaction between international investment law, human rights law and domestic law, as well as enforcement prospects.
