Selectie En Publicatie Van Rechterlijke Uitspraken in Rechtsvergelijkend Perspectief (Selection and Publication of Judicial Decisions in a Comparative Law Perspective)

Abstract

In Nederland worden publicatiewaardige uitspraken door de gerechten zelf geselecteerd op basis van de selectiecriteria van Rechtspraak.nl. Maar hoe is dit elders in Europa geregeld? Is er een juridisch kader voor selectie en publicatie van uitspraken? Worden in andere landen meer of minder uitspraken op internet geplaatst? Welke regels hanteren buitenlandse gerechten voor anonimisering en hoe is de publicatie van uitspraken elders georganiseerd?

In the Netherlands courts themselves decide on which judgments have to published, based on predefined selection criteria. But how is this regulated elsewhere in Europe? Are there legal frameworks for the selection and publication of case law? How many decisions are published in other countries? Which rules do foreign courts apply for rendering decisions anonymous? And how is the publication process organized?
