Abstract

Military action by the U.S. in the war against terrorism since September 11, 2001 resulted in large numbers of detainees in Guantanamo Bay, Cuba held under executive authority and robbed of their basic procedural law privileges. The admission of detention without trial and the exclusion of access to courts and legal representation caused worldwide criticism. The legal view of the then U.S. government was also the subject of an applications to the U.S. Supreme Court. This article deals with the various statements and views in the various rulings in respect to the legality of these trials.

DIE SAAK VIR DIE GUANTANAMO BAAI AANGEHOUDENES IN DIE VSA EN ANDER HOWE Militeˆre optrede deur die VSA in die oorlog teen terrorisme sedert 11 September 2001 het tot gevolg gehad dat groot getalle aangehoudenes in Guantanamo Baai, Kuba ingevolge aanhoudingsbevele deur die uitvoerende gesag van hulle basiese prosesregtelike voorregte beroof is. Die toelating van aanhouding sonder verhoor en die uitsluiting van toegang tot die howe en egsverteenwoordiging het weˆreldwyd kritiek uitgelok en in die jongste tyd het die standpunte van die VSA regering ook die onderwerp van aansoeke voor die VSA en ander howe vir die herstel van habeas corpus bevelskrifte, geword. Veral van belang is die uitsprake van die VSA supreme court wat van die aansoekers se regte herstel het en die´ artikel handel met die verskillende uitsprake en standpunte wat in die onderskeie beslissings ter sprake gekom het.
