Abstract
The New York Convention of 1958 on the recognition of foreign arbitration awards is one of the most successful existing Conventions. The great number of countries which are parties to it and its universal scope endorse its success. Though the New York Convention receives a broad application in the world some differences exist in the several jurisdictions as to its practical implementation and interpretation. This article studies the way the Convention is applied by Spanish Courts. All existing Spanish case-law as regards the interpretation of the Convention is studied in depth. The article shows that although the Conventions receives an usual smooth implementation in Spain some risks exist and some misunderstandings remain as regards its application regarding the recognition of foreign arbitration awards in Spain.
