Recent Development: The Victims’ Rights Amendment

Abstract
This Article analyzes the proposed Victims’ Rights Amendment, one of the few proposed constitutional amendments that has both been repeatedly considered, and has survived the Judiciary Committee to reach the floor of the Senate. It analyzes the provisions of the proposed amendment and identifies a number of concerns regarding its interpretation. Finally, it contends that in light of these concerns, an ordinary legislative solution is preferable, and explains the comparative advantages of a statutory solution.
